A SALMON poacher threatened to stab a fisheries officer with a knife during a foot-chase on the west Clare coastline almost two years ago, a court has heard. At Kilrush District Court sitting in Ennis, Judge Mary Larkin convicted John Linnane (43) of making a threat to Inland Fisheries Ireland Officer, Raymond Byrne intending Mr Byrne to believe it would be carried out to kill or cause him serious harm at Carrowdotia, Killimer on June 1st 2020 contrary to Section 5 of the Non Fatal Offences Against the Person Act. In evidence, Mr Byrne told the court that during the chase, Mr Linnane of Griffin Road, Kilrush said to him that “he wouldn’t do time for this and that he had a knife in this pocket and he would take it out and stab me with it”. A MAN has appeared in court charged with sexually assaulting and falsely imprisoning a woman on multiple occasions over a two-year period in Clare. The 47-year-old man has also been charged with coercive control of his spouse in what is understood to be the first domestic violence charge of its kind to be brought before the courts in Clare. In total, the man is facing 22 charges comprising 12 counts of sexual assault; six counts of false imprisonment; two counts of assault causing harm; one count of criminal damage and one count of coercive control. The charges arise from alleged offences at two locations in Clare, allegedly committed on various dates between 2018 and 2020. The case concerns one alleged female victim. The charge of coercive control states that on a date unknown between January 1, 2019 and May 5, 2020, the accused man did knowingly and persistently engage in behaviour that was controlling or coercive and which had a …

A 16-year-old male has been charged with violent disorder arising from a late night row in Kilkee that saw three people sustain head injuries, writes Gordon Deegan. At the Children’s Court of Kilrush District Court sitting in Ennis, Sergeant Louis Moloney said that CCTV footage shows the teenager – then aged 15 – breaking a bottle off a wall and running with it towards a row which was off camera. In the case, the teenager is charged with committing violent disorder at the Strand Line, Kilkee, on July 31 2020 contrary to Section 15 of the Criminal Justice Act. Sergeant Moloney said that no injured party named the teenager as the person who carried out the attacks on the three injured parties. He said that one of those assaulted required 43 stitches and staples to injuries to his head and arm. Sergeant Moloney stated that another male required five staples to a head injury and a female required five stitches …

A second man has appeared in court concerning an organised public fist fight in a field outside Kilrush that was videoed and later uploaded to Facebook and Youtube. At Kilrush District Court this week, Inspector Tom Kennedy said that it will be alleged that Detective Garda Conor Flaherty, while on mobile patrol on August 5 last, observed a bare chested Alan Clohessy, (27), with his hands taped engaged in a fist fight with another bare chested man in a field in Cappagh, just outside the town. The alleged fight between Mr Clohessy of Frances Street, Kilrush and the another man was filmed and later uploaded to social media. Between 20 and 30 males were watching the fiust fight. In the case, Mr Clohessy is accused of breaching Section 16 of the Criminal Justice Public Order Act where he is alleged to have committed an affray with another man in that he used or threatened to use unlawful violence towards each …

A 70-year old man is to be sentenced next month for sexually assaulting a man in his eighties on a bus travelling through west Clare last Summer. During the course of the assault on June 9 last, a passenger sitting across the aisle from the two men on the west Clare Bus Éireann service to Ennis filmed the assault. The footage from the passenger’s smart phone along with CCTV footage of the attack would have formed part of the State’s evidence if the case had gone to trial. However, the 70-year old’s plea of guilty recorded at Kilrush District Court this week has eliminated the need for the video evidence to be shown and also for his elderly victim to go into the witness box and give evidence. At Kilrush District Court on Tuesday, Judge Patrick Durcan calculated that Mary Maughan receives €55,000 a year on various State benefits. Addressing Ms Maughan, Judge Durcan said, “You receive around €55,000 a year in benefits and if you were paying tax and all of that, you would need an income of €120,000 a year”. In the witness box, Ms Maughan replied, “probably”. Judge Durcan continued, “People are always complaining that the level of social welfare payments are inadequate – that is a political view – and the court cannot comment on something like that otherwise than to note.” Solicitor Tara Godfrey said the payments are required for the care of six children. Ms Maughan receives benefit payments concerning her own four children, along with two other children she is guardian of. In the second cash seizure at Shannon airport within a week and the seventh so far this year, Revenue officers seized €9,000 in cash from a Polish woman at Shannon Airport on Monday. The woman, in her twenties, was stopped and questioned by Revenue officers prior to boarding a flight to Wroclaw in Poland. Officers seized the cash in accordance with proceeds of crime legislation and were granted a three month detention order today (Tuesday) by Judge Patrick Durcan at Kilrush District Court to facilitate further investigations.

A 62-year-old Kilkee farmer charged in connection with the dumping of decomposing carcasses at Baltard Cliff last year was advised by Judge Patrick Durcan to seek legal representation before his next court appearance. Martin Gerald Foley of Lislanahan appeared before this week’s sitting of Kilrush District Court in connection with the discovery of approximately 17 animals at the base of Baltard Cliff, near Doonbeg, on dates unknown between April 20, 2013 and March 31, 2014. He was charged with dumping the animals in  a manner that is likely to cause environmental pollution, contrary to Section 32 of the Waste Management Act. During the hearing, Inspector John Ryan said the Director of Public Prosecutions had instructed that the case be heard in the circuit court.
