Clare cannabis case set to be heard in circuit criminal court

The case of a man accused of the unlawful cultivation of cannabis plants in Newmarket-on-Fergus will be heard in the circuit criminal court.

Ciaran Cullinan (32), with an address at Curraderra, Barefield, appeared before Ennis District Court charged with three offences contrary to the Misuse of Drugs Act. 

Cullinan is charged with possession of cannabis and possession of cannabis for the purposes of sale or supply.

He is further charged with the unlicensed cultivation of cannabis plants. 

All three charges relate to a garda search of Cullinan’s former address at the Green Door apartment, Newmarket on Fergus on April 2, 2021. 

Sergeant Noel O’Rourke gave evidence of the arrest, charge and caution of Cullinan. The court heard the accused made no reply to any of the three charges after caution. 

The accused was represented in court by solicitor, John Casey. 

Sergeant Aiden Lonergan said the garda file in the matter had been forwarded to the director of public prosecutions (DPP).

Sergeant Lonergan told the court the DPP had directed trial on indictment in Ennis circuit criminal court and time would be required to prepare the book of evidence.

Sergeant O’Rourke said he had no objection to Cullinan being granted bail subject to conditions. 

Sergeant O’Rourke said the accused would be required to surrender his passport and provide an address that is acceptable to gardaí. 

Cullinan could also be required to sign on three times a week at a 24 hour garda station and provide a mobile phone number. 

Judge Mary Larkin remanded Cullinan in custody with consent to bail. 

Ciaran Cullinan appeared back before Ennis district court, via video-link, last Friday. 

Sergeant Louis Moloney said the State were seeking to have the accused further remanded to allow time for service of the book of evidence. 

Judge Larkin remanded Ciaran Cullinan in custody with consent to bail to appear again in court on December 14.
