Residents in East Clare are celebrating a planning victory after winning a judicial review overturning planning permission for a controversial mast proposed for Scariff. Eoin Brady of FP Logue LLP Solicitors, took judicial review proceedings on behalf of East Clare residents challenging planning permission granted to Eircom Limited in January 2023. This involved the replacement of a 12 metre wooden pole with a 21 metre high telecommunications monopole together with antennas, dishes and associated telecommunications equipment, enclosed by security fencing at Connacht Road, Scariff. The Bord Pleanála order for the telecoms mast was quashed and the matter has been sent back to the board for further consideration. CONTROVERSIAL plans for a large telecoms mast at the Eir Exchange in Scariff have been given the green light by An Bord Pleanála. While the Council had refused the mast last August, the appeals board has now overturned that decision Developer Eircom, trading as Eir, lodged an appeal last September after its proposals to remove an existing wooden pole and replace it with a 21m structure were turned down by the local authority. It followed a major campaign of opposition from local residents and a group called East Clare Community Residents. Deputy Michael McNamara had also made a representation asking the Council to engage with those who had made submissions. CONTROVERSIAL plans to replace an existing telecoms mast in Scariff with a much higher structure have resurfaced, now that the developers have lodged an appeal. While the Council rejected permission for a 21m structure in the town, Eir have now told An Bord Pleanála they are willing to reduce the height of the mast to 18m, if necessary. Making the offer to reduce the height, the appeal document warns that refusal “will reduce the quality of service to the wider area” and “result in a reduction for other digital coverage providers to gain representation on it”. In documents submitted by agents Towercom, Eircom Ltd, trading as Eir, acknowledges the Council’s refusal of planning permission on the grounds of mast’s visual impact on the town and a scenic East Clare route. A LETTER from a major international company supporting an application for a communications tower in north Clare has warned service will suffer if planning is not granted. Vodafone has supported the planning application by Vantage Towers Ltd for a 30-metre mast at Gortaclob, Doolin. The telecommunications giant said it plans to use the structure if it is granted planning permission and in its supporting letter stated that failure to progress it “could have a negative future impact on network subscribers enjoying future technologies”. Vantage has sought permission for a 30-metre lattice telecommunications support structure, with antennae, dishes and associated equipment at Gortaclob, Doolin. In the application Vantage Towers said the proposal would improve the service in the area. “There is a clear deficiency in basic 4G coverage especially towards Doolin to the southwest of the proposed site, and the surrounding regional road network, with substantial areas of fair and fringe.” The company claimed current customer demand is not being met …

A CONTROVERSIAL plan to install a 21-metre mast in the centre of Scariff has been defended by its developers, on the basis that it will future proof the area’s communications needs. Proposals lodged by Eir at the end of last year, sparked considerable local alarm over moves to replace a 12m pole at the exchange of The Connacht Road with a much larger structure. A total of ten objections were lodged, including one with a petition containing 48 signatures. Against that backdrop, County Planners contacted Eir in February seeking Further Information (FI) on a number of of aspects of the mast plan. The company has now responded. Planners had raised concerns over the proposed location of the mast, which would be just 15m from a number of local homes and the potential for “an over-bearing, imposing effect”. HIBERNIAN Cellular Networks Ltd has been refused planning permission to retain land reclamation works, infilling and the placing of a fence and hardcore gravel at Woodcock Hill. It has also been refused permission to install a 30 metre telecommunications mast. Submissions had been made claiming that the development was unnecessary, with other structures in the area which meant another one was quite unnecessary. The order of Chief Executive Pat Dowling stated that the development would have a negative impact on the environment. “The proposed development if permitted will result in a net loss of the habitats Upland Blanket Bog and Wet Heath within the NHA site Woodcock Hill Bog, both habitats which are qualifying interests for the designated site. “Therefore, the proposed development would be contrary to the Clare County Development Plan and would be contrary to the proper planning and sustainable development of the area.” It also stated that the Council was of the view that the applicant hadn’t …

PERMISSION has been granted to a telecommunications company to extend a mast in north Clare by 30% Ontower Ireland Limited’s application to install a 6m extension to a 20m lattice telecommunications support structure at Gragan West, Ballyvaughan, was approved by planners. FURTHER objections have been lodged in response to a plan from Eir to install a 21-metre mast on its exchange in Scariff. Submissions are currently being accepted on the planning application, which could see the replacement of an existing 12-metre wooden structure with a much higher telecommunications mast with dishes, antennas and other equipment. More concerns have been voiced locally, in recent days, this time from residents of the nearby Connaught Road and Derg View development. Additional letters of objection have estimated that the proposed structure would be located just ten metres from some of the homes in the adjacent estate. The submission contends that a mast on the scale of that proposed should not be allowed in such close proximity to the residential development.
