AN alleged illegal moneylender has appeared before a sitting of Kilrush District Court accused of engaging a man to threaten to shoot or torch the home of a debtor. John Thomas Naughton (64), with an address at O’Gorman Street in Kilrush, appeared before the local district court this week charged with engaging in moneylending without a moneylender’s licence granted by the Director of Consumer Affairs on a date unknown between April 1, 2014 and May 31, 2014. The offence is contrary to section 98(1) of Consumer Credit Act 1995. He is further charged that at O’Gorman Street, Kilrush he did without lawful excuse, through a third party, make a threat intending that it would be feared it would be carried out, to damage the house belonging to the injured party in the case. TWO men in their twenties and two women in their thirties with Kilrush addresses appeared before Ennis District Court this afternoon charged with breaches of the Consumer Credit Act of 1995. The four were Diana Casey, 12 Wood Road, Kilrush; Patrick Casey, Beverley Hills View, Kilkee Road, Kilrush; Ann Marie O’Brien, 12 Sycamore Drive, Kilrush and James O’Brien, 28 Chapel Drive, Kilrush. All were remanded on bail until March 18, when they will appear before Ennis District Court once more. Similar conditions were imposed on all four in relation to bail. The defendants are required to sign on at Kilrush Garda Station on Tuesday, Thursday and Saturday. They are also required not to come within 100 metres of Kilrush Post Office between 8.30am and 1pm on Tuesday and Thursday, nor to have any contact with the complainants.

As part of an ongoing investigation into unlawful money lending, gardai in Clare have arrested 11 people following searches in the Kilrush on Tuesday morning. The searches, which commenced at 7am, were carried out at a number of premises in the area, including private and business premises and involved local gardaí assisted by Criminal Assets Bureau, Regional Support Unit, Special Dectective Units from Galway, the National Criminal Intelligence Unit as well as offcials from Revenue, Social Welfare and Clare County Council. The arrests include five males aged between 18 and 55 years, and six females aged between 20 and 49 years. All those arrested are detained at stations in Clare, Limerick and Galway under Section 4 of the Criminal Justice Act. The investigation, which has been ongoing for several months, centres around complaints received from various individuals and is focused on persons suspected to be engaged in unlicensed money lending.
