TWO men in their twenties and two women in their thirties with Kilrush addresses appeared before Ennis District Court this afternoon charged with breaches of the Consumer Credit Act of 1995. The four were Diana Casey, 12 Wood Road, Kilrush; Patrick Casey, Beverley Hills View, Kilkee Road, Kilrush; Ann Marie O’Brien, 12 Sycamore Drive, Kilrush and James O’Brien, 28 Chapel Drive, Kilrush. All were remanded on bail until March 18, when they will appear before Ennis District Court once more. Similar conditions were imposed on all four in relation to bail. The defendants are required to sign on at Kilrush Garda Station on Tuesday, Thursday and Saturday. They are also required not to come within 100 metres of Kilrush Post Office between 8.30am and 1pm on Tuesday and Thursday, nor to have any contact with the complainants.  

A-35-year old sex offender, who has been living in the Ennis area but failed to comply with a requirement for him to notify a change of his address with the gardaí, has this week received a four month prison term. The defendant, who is currently of no fixed abode, initially appeared before Ennis District Court on Wednesday charged under the Sex Offenders Act 2001 with failing to notify a change of address between December 4, 2014 and December 14, 2014. On that date, Detective Garda John Casey outlined to the court that the defendant was convicted in the Central Criminal  Court on April 25, 2005 and was placed on the Sex Offenders’ Register. Following his release from his sentence charges of sexual assault and rape of a male person, the defendant was required under the Sex Offenders Act 2001 to notify gardaí of his home address. An 18 year old has appeared before a special sitting of Ennis District Court this Saturday morning charged in connection with the seizure of approximately €70,000 worth of drugs. Ronan Carroll with an address at Cahermore, Cree is charged with possession of cannabis for sale or supply at an address at Beechpark in Ennis. Evidence of arrest charge and caution was given by Garda Brian O’Callaghan, who outlined that the defendant was arrested in Ennis on Thursday night. The defendant was granted bail and was remanded to reappear before Ennis District Court on January 21 next.

An 80 year old former national school principal. who “robbed his victims of their childhood” has received an 11 year sentence, with five years of it suspended at Ennis Circuit Court today, Wednesday. Patrick Barry, of Well Road, Kilkee had pleaded not guilty to charges of indecently assaulting 11 women, who were pupils of his at Moyasta National School between 1964 and 1985. Having been found guilty by a unanimous verdict by a jury last July on 59 counts of indecent assault  Barry was sentenced by Judge Gerald Keys this week. Judge Keys structured the sentence so that Barry received a year sentence on each count of indecent assault in respect of the abuse he caused to each victim. While these sentences were to be served concurrently he ordered they run consecutively to one another giving a total sentence of 11 years. A 30 year old man has appeared before a sitting of Ennis District Court this Thursday in connection with an alleged hit and run incident at Knockadoon, Tulla on October 28 last. James O’Donoghue with an address at Bay 8, Lynch’s Lane, Clondalkin, Dublin 2, appeared before Judge Aeneas McCarthy on Thursday charged with a single charge of dangerous driving at Knockadoon on October 28. Inspector Tom Kennedy, prosecuting, outlined that the State would allege that the accused was involved “in a hit and run incident in which the defendant crashed his car into another vehicle, he then left the scene and later turned up at hospital”. Garda Darren McLoughlin of Scariff garda station gave evidence of arresting the defendant, charging him and administering the relevant caution. A CUBAN  man, with a Paris address, who was flying to Cuba to say a final farewell to his terminally ill father, but whose actions aboard the flight resulted in the plane being diverted to Shannon, will now not get to say goodbye. Ronar Caballero Gomez, (37),  with an address at 1 Avenue Becquerelle 92600 Asnieres, Sur Seine, Paris appeared before Ennis District Court in respect of an air rage incident on a Condor Airlines flight from Frankfurt, Germany to Holguin, Cuba, which diverted to Shannon on Wednesday. He was fined €1,000 arising from the incident. Gomez pleaded guilty to engaging in behaviour likely to cause serious offence or annoyance to any person on board the aircraft on April 30; engaging in behaviour of a threatening, abusive or insulting nature by gesture with intent to cause a breach of the peace and being intoxicated on board the flight also on the same date contrary to the Air Navigation and Transport …

THREE Clare men have been sentenced for their part in the robbery of a pensioner who left his home by bicycle following the ordeal and continues to live in a nursing home. Noel Garry, aged 20 of Cooraclare, was sentenced to three years after pleading guilty to his involvement in a second robbery at 68 year old Michael McMahon’s home in West Clare. Mr Garry was described as the “most culpable of the three” involved in the case before Ennis Circuit Court this week. The Circuit Court was told that Mr McMahon cycled through the night from his home after it was targetted by around five criminals in two separate robberies on February 21 and 25, 2012 in which a total of between €7,000 and €8,000 was stolen. 21 year old Joseph Lernihan of Finnuremore Park, Mullagh, who admitted involvement in both robberies, was given a three year suspended sentence and ordered to pay the victim compensation of €3,790. 20 …

By CAROL BYRNE A 67 year-old man cycled 30miles with all his belongings in the dead of night to a nursing home in Ennis to take up residence after being subjected to two robberies at his rural West Clare home, Ennis Circuit Criminal Court has heard. The details emerged at the sentencing hearing of Noel Garry, (20), of Cooraclare; Shane Donnellan, also 20 years of age of Clohanbeg, Cree and Joseph Lernihan, (21) of Finnemore Park, Mullagh on Monday. They all pleaded guilty to robbing €3,000 from the man at his rural home in West Clare on February 25, 2012. Joseph Lernihan also admitted a further charge of robbery of €4,000 from the same man days earlier on February 21, 2012. Detective Garda Donal Corkery said the victim is 68 now and resided alone in a rural isolated location. “The nearest village was two miles away.
