Murder charge follows incident in Ennis

  A SERIOUS incident in Ennis on Tuesday afternoon led to a 39-year-old- man appearing in court this Friday charged with the murder of a local man, Eoin Boylan.   At Ennis District Court, Nassar Ahmed of The Mews, Kilrush Road, Ennis appeared after being charged with the murder of mature student, Eoin Boylan, aged 32, at Gordon Drive, Cloughleigh, Ennis on April 14.   Mr Boylan was rushed to hospital after an incident at Gordon Drive on Tuesday afternoon, but died en route.   Giving evidence of arrest, charge and caution, Detective Garda Noelle Bergin told the court that she arrested Mr Ahmed for the purpose of charge at 23.45 at Ennis Garda Station on Wednesday night.   The garda told the court that Mr Ahmed replied ‘Okay’ after being charged with the murder offence.   After reading the charge, Judge Mary Larkin told the court “this is a serious matter”. Woman attacked with brush handle in Lisdoonvarna

A CLARE man who is accused of attacking his former partner with a brush handle is to be assessed by a forensic psychiatrist as a matter of urgency. The 33-year-old, who has an address at The Mews, Lifford, in Ennis appeared before Limerick District Court this Friday [September 14] after he was charged with assault causing harm in relation to an incident near Lisdoonvarna on Tuesday. Detective Garda TJ Molloy said it will be alleged that a 30-year-old woman was struck with a brush handle and that a knife was held to her throat during the incident on Tuesday evening. He said gardaí were alerted by neighbours who were alerted to a commotion inside the caravan where the woman lives on the grounds of Ballinalacken Castle Hotel. “It was a loud verbal and physical altercation,” he said adding that witnesses described seeing the caravan “shaking viciously”. Ennis auctioneer to serve eight years for rape

A man “of some standing” in his community who repeatedly raped his friend’s daughter when she was a child has been jailed for eight years. Noel Kelleher (64) was found guilty by a jury of six counts of rape, three counts of sexual assault, three counts of oral rape and one count of attempted oral rape of his victim at various locations in County Clare between June 1991 and August 1992. Kelleher, of Gort na hAbhna, Roslevan, Ennis, was found not guilty of a further 16 counts of rape, indecent assault and sexual assault by the jury following a Central Criminal Court trial last November. His victim, who was aged between 12 and 14 at the time of the attacks, wished to waive her right to anonymity, the court heard. Sentencing Kelleher on Monday, Ms Justice Isobel Kennedy said his abuse had a “deep and long-lasting impact” on his victim, which continues to this day. “These are very serious offences perpetrated …

Further remand for men on alleged farmhouse burglary

  THE four alleged burglars of a rural Clare farmhouse, here a 95-year -old man was asleep last Friday, were further remanded in custody at a court sitting on Wednesday (today). At Ennis District Court, the four Limerick men appeared in court via video link from Limerick prison and Inspector Tom Kennedy applied to the court that the case be put back for two weeks to allow the get the Director of Public Prosecutions (DPP) get directions. In the case of the four, Judge Patrick Durcan remanded all four in custody to re-appear in court on January 24. Two of the four, Paul Kiely (30) of Glencairn, Dooradadoyle, Limerick and Edward Woodland (18) of Greenmount Avenue, Ballinacurra Weston, Limerick have consent to bail if they can provide an independent surety, but they have not provided an independent surety to date. Court gives €49k to charities

MORE than 50 charitable organisations and community groups have benefited to the tune of €49,000 from the proceeds of the court discretionary fund. The amount raised this year is €7,000 more than the accumulated funds divided out last year, with 21 more organisations seeing the benefit. A payment to the court discretionary fund is typically ordered by Judge Patrick Durcan in minor cases, in particular in the case of first offenders. The payment is often ordered in lieu of recording a fine and conviction. This year’s fund has been divided across 51 local and national organisations, with the largest beneficiary the Bedford Row Family Project Ltd in Limerick, which supports the families of prisoners. The group has received €10,000 from the fund. St Vincent De Paul services in Clare was the next biggest beneficiary. Ennis received €3,000 from the fund and St Senan’s Kilrush Conference St Vincent De Paul received €2,000. Four organisations benefited from €1,500 each – the Garda …

Clarecastle man pleads guilty to dealing Cocaine

A 62-year-old Clarecastle man has pleaded guilty to having €4,000 worth of cocaine in his possession for sale or supply at a sitting of Limerick District Court this week. Gerard Casey of 68 St Joseph’s Terrace, pleaded guilty to charges of having cocaine for sale or supply and possession of the illegal drug on April 20, 2017 at a sitting of Limerick City District Court on Monday, October 2. The Clarecastle man has admitted having the drugs at Bunlicky – a townland on the N18 earlier this year. The court heard that the Director of Public Prosecutions had consented to the matter being dealt with summarily before the district court on a plea of guilty only, and jurisdiction was accepted. A probation report was ordered and the matter was adjourned to December 6 next for this to be prepared and it is likely that sentencing will take place on that date.

West Clare Man Facing Trial Over Fatal Inagh Crash

A 60-year-old West Clare man has appeared in court this week charged with dangerous driving causing the death of three-year-old Estlin Wall in Inagh earlier this year. Senan O’Flaherty, with an address at Lower Gowerhass, Cooraclare appeared before Ennis District Court on Wednesday. He is charged with dangerous driving causing the death of Estlin Wall at Ballyea South, Inagh on March 15, 2017. The substance of the charge alleges that the defendant drove in a manner, including speed, which, having regard to the circumstances of the case, was dangerous to the public thereby, causing the death of Estlin Wall. Garda Ruth O’Sullivan gave evidence of arresting Mr O’Flaherty at 9.45pm on Monday, September 30 at his address. She said he made no reply after caution in respect of the single charge of dangerous driving causing death. Solicitor Joe Chambers, representing the defendant in court, said he did not have an application for free legal aid. Inspector Tom Kennedy, prosecuting, outlined that the Director of Public Prosecutions had directed that the case proceed on indictment to the Circuit Criminal Court for trial. He said a Book of Evidence would be required in the matter and requested an adjournment to facilitate this. Judge Patrick Durcan, presiding, adjourned the case to December 13 next and granted an application to extend time to serve the Book of Evidence in the case. It is expected that the book will be served on the accused on that date Estlin Luna Wall was the daughter of Amy Dutil Wall and Vincent Wall from Ennistymon and was a sister to Mannix. She died just 11 days shy of her fourth birthday. Her dad, Vincent, is the brother of Steve and Joe Wall of the band The Stunning. He was also in the car on the day she was killed. The family, who run a framing business in Ennistymon, made the decision to donate Estlin’s organs before taking her off life support a number of days after the crash. Arising from the tragedy, Steve Wall set up an online fund to help the family and it received a significant amount of support, with more than €70,000 raised for the family. Donations above this were made to Temple Street Children’s Hospital. In memory of Estlin, her former créche, Inagh Ark Childcare, planted a pink cherry blossom tree. They said when they look at it, they will recall Estlin as “the most beautiful girl with curly fair hair”, “funny, witty, playful and loveable. She had a heart of gold and the most infectious smile”.

“Nobody was meant to die that night”

A 21 year-old Kilrush man charged with assaulting the late Karl Haugh causing him serious harm told gardaí after caution, “Nobody was supposed to die that night”. Robbie Walsh, of 20 Island View, Kilrush appeared before Judge Marie Keane at Ennis District Court this Tuesday morning charged with assault, intentionally or recklessly causing serious harm, to Karl Haugh at Marian Estate, Kilkee on Sunday, August 6. During the brief hearing, Garda David King gave evidence of arresting and charging Mr Walsh at 5.53pm on Monday. He said having been cautioned Mr Walsh made the following response, “nobody was meant to die that night”. An application was made by solicitor Edel Ryan of Patrick Moylan Solicitors for free legal aid and this was granted. An application for bail was refused by Judge Keane following a bail hearing. She directed that while on remand that all appropriate intervention regarding drug addiction be made.
