Man who raped niece due for sentencing

A Clare resident who began sexually abusing his Limerick niece from the age of six will be sentenced next week at the Central Criminal Court. The 48-year-old man, who cannot be named for legal reasons, later began raping the child from when she was aged nine on a regular basis in his bedsit in County Clare. The court heard how the child would beg her mother not to let her stay over with him, telling her mother: “Please Mum, don’t let me go, I’ll be good”. During the trial the victim said her mother would still let her uncle take the child to the flat every few weeks. While staying over with him, the man would molest the child and force her to touch his private parts. He also forced her to perform more explicit sexual acts on him, including oral rape. Clare man charged with rape in Galway

A 20-year-old County Clare man has been charged with the rape of a woman in a Galway city apartment last year. The man, who cannot be named for legal reasons, appeared before Galway District Court on Monday where he  denied two counts of raping the woman on the night of July 23-24, last year, contrary to Section 4 and Section 21 of the Criminal Law Rape Amendment Act, 1990. Garda Conor Barrett gave evidence of going to the man’s home earlier that morning and arresting him. He took him to Galway Garda Station and charged him there. He said the man replied “not guilty” to both charges. Garda Barrett said he had no objection to bail provided conditions were attached. Judge Aeneas McCarthy remanded the man on his own bail of €1,000 with no lodgement required, to appear before the court again on March 11 for service of a Book of Evidence. Sentence reactivated after child porn possession

A CLARE man, who was previously jailed for repeatedly raping and sexually abusing a child, has had the suspended portion of that sentence reactivated for possessing and distributing child pornography. The 33-year-old man, who cannot be named for legal reasons, received a sentence of seven years, with two years suspended in 2010, after pleading guilty to three charges of sexual assault on dates between January 1, 2002 and December 31, 2003. His victim was under 10-years-old at the time, while the accused was 21 when the abuse first started. At Dublin Circuit Criminal Court on Wednesday, Judge Mary Ellen Ring granted an application by The Probation Services to reactivate the suspended portion of that sentence. The court heard that the accused has entered a plea of guilty at Ennis Circuit Criminal Court to distribution and possession of child porn and is awaiting sentence. Prison sentence for sexually assaulting child

By Aoife Nic Ardghail A TWO and a half years in prison sentence has been imposed on a Clare man for sexually assaulting a then eight-year-old girl in her home. The 53-year-old man pleaded guilty at Dublin Circuit Criminal Court to sexually assaulting the girl by touching her private parts on November 23, 2009. He has no previous convictions. Judge Mary Ellen Ring said although the man had pleaded guilty, she was concerned that he had not fully accepted the implications of what he had done. An investigating garda revealed that the little girl had been watching TV when the man came into the room and lay down beside her on the sofa. The girl told gardaí the man had touched her chest area and private parts and asked her if she wanted to see his penis. The girl said “no” and nothing else happened.
