Judge doesn’t buy explanation that sulky horse windfall paid for €43k jeep in €50 notes

An UNEMPLOYED Ennis man has failed to convince a judge that the €26,000 he received for ‘three trotters’ helped finance him purchasing a Toyota jeep for €43,000 in cash in €50 notes. At Ennis District Court, Judge Mary Larkin has dismissed a fresh bid by Ned Doherty (32) of St Michael’s Park, Ballymaley, Gort Road, Ennis to have Gardai return his 20-2 Toyota Hilux jeep. Judge Larkin said that she was “more confused than ever” after hearing about the various sums Mr Doherty is claiming to have used on the jeep’s purchase. Judge Larkin said that the evidence from Mr Doherty was a mix of ‘don’t know’, ‘can’t remember’ and ‘don’t deal with money’. Clare man who bought €43k jeep in cash with €50 notes renews bid to reclaim it from gardai

AN Ennis man who purchased a Toyota jeep for €43,000 in cash in €50 notes in February 2021 has made a renewed court bid to have Gardai return the jeep to him. At Ennis District Court this Wednesday, solicitor Daragh Hassett had before court a Police Property application on behalf of Ned Doherty (32) of St Michael’s Park, Ballymaley, Gort Road, Ennis for the return of his 20-2 Toyota Hilux jeep. Unemployed at the time, Mr Doherty purchased the jeep in cash from a County Roscommon car dealer on February 23 2021 but it was seized 10 days later as part of a wider Garda operation that also involved the Criminal Assets Bureau (CAB) on March 5 2021. Mr Hassett told the court that the vehicle was seized almost two years ago and Mr Doherty has yet to be charged in relation to any offence or for any application to be made by the State to permanently seize the vehicle. …

Man alleged to have thrown cup of urine in face of garda

A man alleged to have thrown a cup of urine at a Garda’s face has been further remanded in custody. Joel Lonia (32), of no fixe abode, made his second appearance at Ennis district court this Wednesday, December 14. Lonia is facing two charges of assaulting two gardaí at Ennis Garda station on December 11, contrary to section 2 of the Non Fatal Offences Against The Person Act. He is charged with the theft of clothes and hiking boots from Penneys, Francis Street, Ennis, also on December 11. He is further charged with engaging in behaviour or using words with intent to provoke breach of the peace or being reckless as to whether a breach of the peace may be occasioned. That offence relates to an incident at the Templegate Hotel, Ennis on December 11. Farmer in right of way dispute told to keep the peace

A judge has told an 80-year-old Clare farmer to keep the peace and to wait for a court to rule on a long running right of way dispute. At Ennis District Court, Judge Mary Larkin told Martin Neylon that he “can’t be calling out Garda Andrew Monahan every two minutes to be sorting out your difficulties”. Judge Larkin told Mr Neylon: “You have to keep the peace between now and then.” Judge Larkin told Mr Neylon to open a gate across a disputed right of way between 12pm and 2pm every day to allow farmer, Donal O’Brien to access his lands pending a circuit court determination in the right of way row. Father and son avoid jail over chaotic ‘Wild West’ confrontation

A FATHER and son have narrowly avoided jail for their role in a chaotic late night farm yard scene compared by a judge to something from the Wild West. At Kilrush District Court on Tuesday, Judge Mary Larkin imposed prison terms on Denis Waters (53) and his son, Brian Waters (25) after they confronted Gardai with a pitch fork and a calving jack during a late night incident at Derreen, Tullycrine near Kilrush on October 26 last year. Judge Larkin imposed a six-month prison term on Denis Waters and a three-month prison term on his son, Brian. However, Judge Larkin imposed community service orders in lieu of the prison terms after the Probation Service deemed both father and son suitable for community work. Judge Larkin has ordered Denis Waters to carry out 160 hours community work and Brian Waters 120 hours community work in lieu of the prison terms. Clare man accused of quick-fire crime spree refused bail

A MAN alleged to have carried out a burglary and four thefts over a 45-minute period in Ennis on Wednesday, has been refused bail.  Nathan Egan (29), with an address at Sandfield Court, Ennis, appeared at Ennis district court this Thursday charged in connection with a series of offences at businesses in the town centre on October 12.  Egan is charged with stealing various items from Haven Pharmacy, Abbey Street; Lifestyle sports, High Street, and Eurogiant, O’Connell Square.  He is also accused of stealing a racer bike valued at €1000 at the Friary car park.  Egan is further charged with entering the Queens Hotel as a trespasser with intent to commit theft.  Garda Joe Kearney told the court he arrested Egan on Abbey Street at 6.20pm on October 12. The court heard the accused was charged with five offences.  Garda Kearney said the accused made no reply to any of the charges after caution. Solicitor Tara Godfrey applied for bail …

‘Smirking’ defendant might be cured by jail, says judge

A JUDGE has asked if a few weeks in jail would cure a “smirking” Shannon man who threatened to “karate kick” a garda. Judge Mary Larkin was speaking at Ennis district court after hearing details of a public order incident that occurred in the Fairgreen, Ennis on June 29, 2022. Outlining the facts of the case, Sergeant Aiden Lonergan told the court that gardaí responded to a health call at the popular public park on the date in question.  Sergeant Lonergan said gardaí spoke to Lee Mulqueen who became verbally abusive and aggressive.  The court heard Mulqueen told gardaí, “F**k off ye fat b******s. Ye are nothing but scumbags. Come near me and I will karate kick you into the head, go f**k yourself”.  Sergeant Lonergan said Mulqueen refused to comply with a direction to leave the area and continued to be abusive.  Mulqueen, with former addresses in Shannon and Connolly Place, Waterford city, pleaded guilty to engaging in behaviour …

Man appears in court charged over Clare cocaine seizure

A MAN has appeared in court charged in connection with the discovery of a suspected quantity of cocaine in the Inch area last week. Dara Maloney (28) with an address at Drumcliff, Ennis, appeared at Ennis district court this Wednesday on two drugs-related charges. He is charged with possession of cocaine and possession of cocaine for the purposes of sale or supply. Both charges arise from the seizure by gardaí of a quantity of suspected drugs in Magowna on the outskirts of Ennis on September 9. A further, more serious, drug-related charge may be brought against the accused, the court heard. Detective Garda Seán O’Sullivan of Ennis garda station told the court that he arrested Maloney in Magowna on September 9 on suspicion of an offence contrary to the misuse of drugs act. The court heard the accused was charged at Ennis garda station on September 10. Maloney made no reply to the charges after caution. Defence solicitor Daragh Hassett …
