Residents in East Clare are celebrating a planning victory after winning a judicial review overturning planning permission for a controversial mast proposed for Scariff. Eoin Brady of FP Logue LLP Solicitors, took judicial review proceedings on behalf of East Clare residents challenging planning permission granted to Eircom Limited in January 2023. This involved the replacement of a 12 metre wooden pole with a 21 metre high telecommunications monopole together with antennas, dishes and associated telecommunications equipment, enclosed by security fencing at Connacht Road, Scariff. The Bord Pleanála order for the telecoms mast was quashed and the matter has been sent back to the board for further consideration. The site is an existing Eir facility and communications exchange to the north east of Scariff, which includes an existing single-storey building with two existing monopole telecommunication structures located within the site, one to the rear and north side of the building, the other to the side and east of the current building. …

MORE than €80,000 has been raised as part of efforts to launch a judicial challenge to the granting of planning permission for a biogas plant in Gort.  Opposition group, Gort Biogas Concern, confirmed earlier this month that legal representation has been secured to initiate the court challenge. The group said it is determined to overturn An Bord Pleanála’s decision to allow the controversial project, in the wake of its rejection by Galway County Council. The Concern Group has also revived its awareness-raising walking campaign which invites people to walk the town’s scenic ‘Golden Mile’ every Sunday to learn more about the project and the strength of local opposition.  A statement from the Concern Group confirmed this week that €82,000 has been raised to-date “in order to protect Gort and South Galway from a catastrophic biogas development”. “From far and near people have donated €82,000 in less than two weeks after the public meeting on January 4,” the statement said. “Contributions …

Less than two weeks after a public meeting to discuss concerns about a grant of planning permission for a biogas plant in Gort, more than €60,000 has been raised to fund a legal challenge. Gort Biogas Concern Group have confirmed to The Champion that legal representation has been secured to initiate a judicial review. The group said it is determined to overturn An Bord Pleanála’s decision to green light the controversial project, in the wake of its rejection by Galway County Council.  “Six days after the meeting over €60,000 had been raised,” spokesperson Ciarán O’Donnell said. “We had around 400 people attend the meeting last week and raised a lot of funds on the night so that we can take a court challenge to this decision. NEW windfarm developments in Clare may be blown off course by High Court challenges, after a group of West Clare residents became the first local opposition group to secure leave for a Judicial Review to overturn planning approval for a local windfarm. High Court Judge Marie Bake has granted members of the Coore/Shanaway Residents Group, represented by Kathleen Connelly, leave to seek a judicial teview of An Bord Pleanála’s decision to grant planning permission for four 85m wind turbines in the Miltown Malbay area, on 10 grounds. The successful application for a Judicial Review was taken by resident Kathleen Connelly, the respondent was An Bord Pleanála, while the notice parties were Clare County Council and McMahon Finn Wind Acquisitions Limited. A spokesman for An Bord Pleanála said the board received the legal papers on Tuesday and has begun work on its response but it is only at the initial stages as yet.
