Galway man committed to Central Mental Hospital

A 41-year-old man who strangled his brother to death with a bungee cord and was found not guilty of his murder by reason of insanity, has been committed to the Central Mental Hospital. Declan O’Cualain, with an address at An Caoran Beag, An Cheathru Rua, County Galway was charged with murdering his brother Adrian Folan (O’Cualain) at Lislorkin North, Liscannor, on July 4 2014. Last month at the Central Criminal Court Mr O’Cualain pleaded not guilty to murdering Mr Folan by reason of insanity. At the beginning of the trial prosecution counsel, Mr Anthony Sammon SC, told the jury that the accused had become “fixated with pedophilia” and held the baseless delusion that his brother was a person “afflicted with this difficulty and he may have sexually abused a sibling”. Man to face trial on charge of murdering brother

A 40-year-old Galway man has been sent forward for trial to the Central Criminal Court, charged with murdering his brother. Declan Ó Cualain, with an address at An Caoran Beag, An Cheathru Rua, appeared before a sitting of Ennis District Court on Wednesday charged with the murder of Adrian Folan (Ó Cualain) on July 4, 2014 at Lislorkin North, Liscannor. Garda Ruth O’Sullivan gave evidence of serving a copy of the Book of Evidence on the defendant’s solicitor, Adrian MacLynn, for his client, Declan Ó Cualain. Inspector Tom Kennedy, prosecuting, outlined that the Director of Public Prosecutions consented to the defendant being returned for trial to the next session of the Central Criminal Court sitting in Dublin, in custody. An application was made by Mr MacLynn to extend free legal aid to cover one senior counsel and one junior counsel.Man facing Mr Ó Cualain was remanded in custody to Limerick Prison, pending his trial. Murder charge over Liscannor quarry death

A 40-year-old man has been charged with the murder of Adrian Folan, whose body was found in a quarry near Liscannor on Monday. He is Declan Ó Cualain (Folan), with an address at Cuileán, An Cheathrú Rua, County Galway, who was brought before a special sitting of Galway District Court this  Tuesday evening. He is a brother of Adrian Folan. A defence application for free legal aid for Mr Ó Cualain was acceded to by Judge Mary Fahy. Defence solicitor, Adrian McLynn also requested that his client receive medical attention while in custody. Mr Ó Cualain has been remanded in custody to appear before Harristown District Court on Friday. Adrian Folan, 41, had been missing from Athlone since July 3. His body was found in a quarry near Liscannor on Monday morning. Mr Folan ‘s body was brought to University Hospital Limerick where the State Pathologist, Dr Marie Cassidy, conducted a post mortem examination on Monday night. Gardaí are not releasing the …
